§1 General Provisions
1. These Terms and Conditions set out the rules for using the online store and the rules for concluding and performing sales agreements via the website.

§2 Definitions
1. Seller – Hold My Neon Karolina Pełka
2. Customer – a natural person, legal person or organizational unit making a purchase
3. Consumer – a natural person making a purchase not directly related to their business activity
4. Product – goods available in the Store
5. Personalized Product – a product made according to the Customer’s specifications
6. Order – the Customer’s declaration of intent aimed at concluding a Sales Agreement
7. Sales Agreement – an agreement concluded between the Customer and the Seller via the Store
8. Terms and Conditions – this document setting out the terms of sale
§3 Rules for placing Orders
Orders can be placed via the website 24/7.
To place an Order, the Customer:
1. selects a Product
2. adds it to the cart
3. fills in the order details
4. chooses the payment and delivery method
5. accepts the Terms and Conditions and the Privacy Policy
6. confirms the order (by clicking the “Buy and pay” button or an equivalent button)
The agreement is concluded when the Seller confirms acceptance of the order (by email).
Personalized Products
In the case of personalized products:
1. the Customer provides the design guidelines
2. the Seller presents a design and a quotation
3. production begins after the design is approved and the order is paid for
§4 Prices, payment methods and delivery
All prices:
• are given in PLN
• are gross prices (include VAT)
Available payment methods:
• via Przelewy24
Products are delivered via courier companies.
Delivery cost:
• within Poland: free delivery
The Customer is obliged to provide correct address details.
If an incorrect address is provided, the Customer bears the cost of re-shipment.
§5 Performance of the sales agreement
Order processing begins after payment is received.
Lead times:
• ready-made products: up to 14 business days
• personalized products: up to 28 business days
Business days: Monday–Friday (excluding public holidays)
§6 Personalized Products
1. Designs created based on the Customer’s guidelines remain the Seller’s property.
2. The Seller has the right to reproduce them unless the Customer purchases an exclusivity option.
§7 Right of withdrawal
1. For personalized designs, the Consumer is not entitled to withdraw from the agreement. Each Product is made to order according to the Consumer’s guidelines.
Article 38 of the Consumer Rights Act – Exclusion of the right to withdraw from an off-premises or distance contract.
3) where the subject of the performance is a non-prefabricated item manufactured according to the consumer’s specifications or serving to meet their individualized needs;
2. For ready-made products, the Consumer has the right to withdraw from the agreement within 14 days from the date of delivery of the Order, in accordance with the Consumer Rights Act.

§8 Complaints and warranty
1. Products are covered by a warranty for 2 years from the date the order is completed.
2. Complaints should be submitted electronically to: contact@holdmyneon.com.
3. Products returned under the complaint procedure should be sent to:

4. The Seller will consider the complaint within 14 days of receiving it.
5. The Customer is obliged to use the Product in accordance with its intended purpose and the maintenance recommendations specified in these Terms and Conditions.
§9 Rules of use and Product safety
1. Products are intended for indoor use by default.
2. The Seller shall not be liable for defects or malfunctioning of the Product resulting from improper use.
3. Visualizations provided by the Seller to the Customer may differ slightly from the final Product.
4. The lifespan of the Product depends on the way it is used. The recommended daily usage time is up to 8 hours. Longer use may shorten the Product’s lifespan.
5. If the Customer provides only one dimension of the Product, the second dimension will be selected proportionally.
6. The Seller reserves the right to manufacture the Product in several component parts so that, once properly arranged, the final result is consistent with what was previously agreed with the Customer.
7. Installation of the Product is the Customer’s responsibility. If the Customer has any doubts regarding installation, they may contact the Seller by email at contact@holdmyneon.com to obtain instructions or technical assistance.
8. The Product is a decorative item and is not intended for play. Due to the presence of cables and other elements, the Product should be kept out of reach of children under 12 years of age. Improper use by children may lead to damage to the Product or create a safety hazard.
9. The Product should be stored and used away from water and moisture sources. It is forbidden to place the Product near heat sources.
10. The Product should be mounted on a stable surface, away from flammable materials.
11. The Product operates on mains voltage – the Customer should ensure that the electrical installation they use is compatible with the Product’s requirements.
12. Do not modify or interfere with the Product’s wiring on your own, as this may result in electric shock or damage to the Product.
13. The Product should be cleaned only with a dry or slightly damp cloth – never use detergents, alcohol or other chemicals that may damage the surface or components.
14. Before cleaning, make sure the Product is disconnected from the power source.
15. If you notice any signs of damage (e.g. a broken cable, unusual smell, flickering light), immediately disconnect the Product from the power supply and contact the Seller.
16. The Product should not be used in rooms with high humidity (e.g. bathrooms).
17. The Product should not be used for any purpose other than the one for which it was designed.
§10 Non-delivery of the Order
1. If the Order is not delivered or collected by the Consumer, and the Seller dispatched the Product on time to the address provided by the Consumer:
• the Consumer bears the cost of return shipping and re-shipment.
• the Seller is not responsible for the Consumer’s absence at the time of delivery or for the actions of the courier company.
2. If the Seller dispatches the parcel incorrectly, the Seller bears the cost of re-shipping the Order.
3. The Consumer may track the parcel if they provided an email address in the order form.
§11 Out-of-court complaint handling and redress
1. Detailed information on the possibility of using out-of-court complaint handling and redress procedures by the Consumer, as well as the rules for access to these procedures, is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodeship Inspectorates of Trade Inspection, and at the following websites of the Office of Competition and Consumer Protection: Consumer disputes; Individual cases; and Important addresses.
2. The Consumer has the following exemplary possibilities of using out-of-court complaint handling and redress procedures:
3. The Consumer is entitled to apply to a permanent consumer arbitration court referred to in Article 37 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended) with a request to resolve a dispute arising from the Agreement concluded with the Seller.
4. The Consumer is entitled to apply to the Voivodeship Inspector of Trade Inspection, pursuant to Article 36 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings for the amicable settlement of a dispute between the Consumer and the Seller.
5. The Consumer may also obtain assistance in resolving the dispute between them and the Seller from a consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Consumer Federation and the Polish Consumer Association).
§12 Final provisions
1. Agreements concluded through the online Store are concluded in Polish.
2. The Seller reserves the right to make changes to these Terms and Conditions for important reasons, i.e. changes in legal regulations, changes in payment methods and deliveries, to the extent that these changes affect the implementation of these Terms and Conditions. The Seller will inform the Customer of any change at least 7 days in advance.
3. In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on Providing Services by Electronic Means; the Consumer Rights Act; and the Personal Data Protection Act.
4. The Customer has the right to use out-of-court complaint handling and redress procedures. For this purpose, they may submit a complaint via the EU online ODR platform available at: http://ec.europa.eu/consumers/odr/.
